Opinion analysis: Justices strike down federal sports gambling law (Updated)

The 10th Amendment provides that, if the Constitution does not give a power to the national authorities or accept that power away in the states, that power has been reserved for the states or the people themselves. The Supreme Court has interpreted this provision to bar the federal government from”commandeering” the states to enforce federal laws or policies. Now the justices ruled that a federal law which bars states from legalizing sports gambling violates the anti-commandeering philosophy. Their decision not merely opens the door for countries around the nation to permit sports betting, but it also could give considerably more power to states generally, on issues ranging from the decriminalization of marijuana to sanctuary cities.
The federal law at issue in the case is the Professional and Amateur Sports Protection Act, which dates back to 1992. The law, called PASPA, bans most nations out of (among other things) authorizing sports gambling; it carved out an exception that could have allowed New Jersey to establish a sports-betting scheme in the state’s casinos, provided that the nation failed within a year. But it required New Jersey 20 years to act: In 2012, the state legislature passed a law that legalized sports betting.
Justice Alito delivers opinion in Murphy v. NCAA (Art Lien)
The National Collegiate Athletic Association and the four major professional sports leagues went into court, arguing that the 2012 law violated PASPA. The lower federal courts agreed, prompting the New Jersey legislature to go back to the drawing board. In 2014, it passed a new law that gathered back existing bans on sports betting, at least since they employed to New Jersey casinos and racetracks. The NCAA and the leagues returned to court, arguing that the new law also violated PASPA, and the U.S. Court of Appeals for the 3rd Circuit again ruled against the state.
The Supreme Court agreed to look at the state’s constitutional challenge to PASPA, and now the court reversed. In a decision by Justice Samuel Alito, the court began by describing the”anticommandeering doctrine may sound arcane, but it’s simply the expression of a fundamental structural decision integrated in the Constitution” –“the choice to withhold from Congress the power to issue orders directly to the States.” And that, the majority lasted, is exactly the issue with the provision of PASPA the nation contested, which bars states from sports gambling: It”unequivocally dictates what a state legislature may and might not do.” “It is as if,” the majority suggested,”national officials were installed in state legislative chambers and were armed with the ability to prevent legislators from voting on any busting proposals. A more direct affront to state sovereignty,” Alito concluded,”is difficult to envision.”
The court rejected the argument, created by the leagues and the national authorities, the PASPA provision barring states from authorizing sports gambling does not”commandeer” the states, but rather simply supersedes any state laws that conflict with the provision — a legal doctrine called pre-emption. Pre-emption, most explained,”is based on a national law which regulates the conduct of private actors,” but “there is just no way to comprehend the provision prohibiting nation authorization as anything other than a direct command to the States,” that”is exactly what the anticommandeering rule does not allow.”
Having determined the PASPA provision barring states from authorizing sports gambling is unconstitutional, the majority then turned into the question that followed by this decision: If the rest of PASPA be broke down too, or will the legislation endure with no anti-authorization provision? The PASPA provision barring the promotion of sports gambling met the same fate; otherwise, the court explained,”national law could prohibit the promotion of an activity that’s legal under both federal and state law, and that’s something that Congress has rarely done.”
The majority acknowledged that the question of whether to legalize sports betting”is a contentious one” which”requires an important policy choice.” But that choice, nearly all continued,”isn’t ours to create. Congress can regulate sports betting right, but when it elects not to do so, every State is free to act on its own.”
Justice Clarence Thomas filed a concurring opinion in which he focused not on the substance of this court’s ruling but rather on a fairly subjective legal question: the viability of this court’s current severability doctrine. Thomas made clear that he joined the majority’s decision striking down all of PASPA since”it gives us the best answer it could to this query, and no party has requested us to apply a different test.” However he proposed that the court should, at some point later on, rethink its severability philosophy, which he characterized as”suspicious” First, he observedthe philosophy is contrary to the tools that courts normally use to translate laws since it takes a “`nebulous inquiry into hypothetical congressional purpose,”’ teaching judges to attempt and figure out exactly what Congress would have wanted to do if part of a law violated the Constitution, when”it appears improbable that the enacting Congress had any intent on this question.” Secondly, he continued, the philosophy”often requires courts to weigh in on statutory terms that no party has” a legal right to battle.
Justice Ruth Bader Ginsburg filed a dissenting opinion. Ginsburg didn’t elaborate on her obvious conclusion (combined in total by Justice Sonia Sotomayor) that PASPA’s pub on the authorization of sports betting from the states does not violate the Constitution. Instead, she argued (also with the support of Justice Stephen Breyer) that, even if PASPA’s anti-authorization supply is unconstitutional, the rest of the law ought to remain in force. “On no rational ground,” Ginsburg emphasized,”can it be concluded that Congress would have chosen no statute at all if it couldn’t prohibit States from penalizing or licensing these schemes.”
New Jersey has long hoped that allowing sports gambling could revive the state’s struggling racetracks and casinos. At some point, the old adage prevailed.
The Patriots set up their’past versus the long run’ clash with an AFC Championship title success with a 37-31 win over the Kansas City Chiefs, the only other team that outplayed the Rams in the 2018-19 year old. For his part, the Rams took a controversial 26-23 overtime win over arguably the best team in the NFL in 2018-19, the New Orleans Saints, aided with a doubtful call by the officials at the final minutes of regulation time.

INITIAL UFC MIAMI CARD REVEALED

The UFC recently revealed the first lineup for UFC on ESPN 3, which takes place April 27 in BB&T Center in Sunrise, Florida. The rumored primary event between middleweight sluggers Yoel Romero and Paulo Costa was not officially announced, but the UFC did affirm a previously-reported light heavyweight bout between Glover Teixeira and Ion Cutelaba, as well as a bantamweight bout between John Lineker and Cory Sandhagen. Souza (13-1) is 2-0 at the UFC and is a former Invicta champion herself, now riding a four-fight win streak overall. That is a winnable fight for Esparza but that I really don’t understand how anyone can have faith in her at this stage. She might be a tiny favorite here, but each of the upside is with Souza.
Andrei Arlovski vs. Augusto Sakai, UFC on ESPN 3
Heavyweights Andrei Arlovski and Augusto Sakai will fulfill with this card. Arlovski (27-18, 1 NC) is 6-8 in his latest stint at the UFC and is currently riding a three-fight losing skid with a choice loss to Walt Harris his last time out. Sakai (12-1-1) is coming from a TKO win over Chase Sherman in his UFC debut and is about a three-fight win streak in general. Arlovski is an easy fade at this point and I anticipate Sakai to bet a good favorite here.
Jim Miller vs. Jason Gonzalez, UFC on ESPN 3
Lightweights Jim Miller and Jason Gonzalez are set to do battle. Miller (29-13, 1 NC) is 18-12, 1 NC all-time in the UFC but has fallen on hard times as of late with losses in five of the last six bouts. Gonzalez (11-4) is only 1-2 in the UFC and has been finished in his losses. Miller is going to be the favored here predicated on name value but I don’t know whether it’s possible to trust him at this point.
Dhiego Lima vs. Court McGee, UFC on ESPN 3
There is also a welterweight bout between Dhiego Lima and Court McGee. Lima (13-7) is just 2-6 in the UFC but is coming from a brutal KO win over Chad Laprise in UFC 231. McGee (19-7) is 8-6 in the UFC and defeated Alex Garcia via decision in his final struggle. I could see this one going either way, either Lima tests McGee’s fading chin or McGee takes him down and smothers him. Start looking for a close betting line here, with perhaps a slight lean to McGee.
Jessica Penne vs. Jodie Esquibel, UFC on ESPN 3
And finally, women’s strawweights Jessica Penne and Jodie Esquibel have been re-booked for this particular occasion as their bout at UFC on ESPN 1 recently fell through following Penne hurt her ankle in warmups. Certainly, it was not a super-serious harm as she will be fighting just over a month afterwards. Penne was a small favorite before the fight was pulled only hours before it was scheduled to occur, and I’d presume the new line will be set right where it left off.

UFC TARGETING KEVIN LEE VS. GREGOR GILLESPIE

It’s likely to be a hard-fought fight, but one I think Gillespie can triumph. I’m curious to see what the betting line will be for this one, but when Gillespie is a puppy there will definitely be value betting on him at plus money.
Chris Gruetzemacher vs. Jesus Pinedo, UFC Fight Night 148
An enjoyable lightweight bout between Chris Gruetzemacher and Jesus Pinedo will take place at UFC Fight Night 148, set for March 23 in Bridgestone Arena in Nashville, Tennessee. Gruetzemacher (12-4) is 2-2 at the UFC and is coming from a barbarous TKO win over Joe Lauzon. Pinedo (16-4-1) is riding a seven-fight win streak and defeated Devin Powell by decision in his UFC debut. Pinedo is a very nice potential but Gruetzemacher has more experience against a high level of competition and based on the win over Lauzon he needs to be at least slightly favored here.
Eric Shelton vs. Jordan Espinosa, UFC Fight Night 148
A rare flyweight bout between Eric Shelton and Jordan Espinosa is set for UFC Fight Night 148. Shelton (12-5) is 2-3 at the UFC and is coming from a split decision win over Joseph Morales. Espinosa (13-5, 1 NC) is riding a four-fight win streak such as a knockout win in Dana White’s Contender Series last summer. Shelton has not been anything special from the UFC while Espinosa looks like he’s some good potential. I would anticipate a close line , with a slight lean to the more dynamic Espinosa.
Chris Gutierrez vs. Ryan MacDonald, UFC Fight Night 148
Additionally at UFC Fight Night 148, bantamweight Chris Gutierrez will fulfill short-notice replacement Ryan MacDonald. Gutierrez (12-4-1) is coming off of a submission loss to Raoni Barcelos in his UFC debut but had won three straight fights before that. MacDonald (10-0) is an undefeated prospect who’s coming off of a submission win in LFA. He’s carrying the fight on short notice for an injured Martin Day. This should be a competitive fight but despite the brief notice, the simple fact that MacDonald has never dropped may make him a little betting favorite at available here.
